FlashQuizAI Sleeping Owl Studios Last Updated: March 5, 2026

Please read these Terms of Service ("Terms") carefully before using FlashQuizAI ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User") and Sleeping Owl Studios ("we," "us," or "our"), the developer and operator of FlashQuizAI. Use of the App is conditioned upon your acceptance of and compliance with these Terms.

2. Eligibility

FlashQuizAI is rated 9+ on the Apple App Store. By using the App, you represent that you are at least 9 years of age. Users between the ages of 9 and 12 must have the consent and supervision of a parent or legal guardian. Users under 18 represent that they have their parent or legal guardian's permission to use the App and to make any in-app purchases.

Notwithstanding the 9+ rating, we do not knowingly collect personal information from children under 13 without verifiable parental consent, in accordance with the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child under 13 has provided personal information through the App, please contact us immediately.

3. Description of the App

FlashQuizAI is a quiz application that uses artificial intelligence and large language models (LLMs) to generate multiple-choice quiz questions on topics of your choosing. The App allows you to:

  • Enter any topic and optional custom prompt to generate AI-powered quiz questions
  • Select difficulty levels (Easy, Medium, Hard)
  • Track your quiz history and performance
  • Earn and view in-app achievements, optionally synced to Apple Game Center
  • Purchase additional question credits or a premium subscription

4. In-App Purchases

4.1 Available Purchases

The App offers the following in-app purchases through Apple's App Store:

  • Premium Monthly Subscription — Increases your daily question credit allowance (from 20 to 50 per day), plus a one-time welcome bonus of 50 extra question credits and 250 Sparks upon first activation.
  • Sparks Packs — One-time consumable purchases that add Sparks (the App's virtual currency) to your balance (available in packs of 100, 250, 500, 1,000, and 2,000 Sparks). Sparks are then used to purchase additional question packs within the App.
  • Question Packs (Sparks-funded) — Additional question credits purchased inside the App by spending your Sparks balance (available in packs of 10, 25, 50, 100, and 200 questions).

All monetary transactions are processed exclusively through Apple's App Store billing system. We do not collect or store your payment information.

4.2 Credit and Currency System

The App uses two parallel systems to manage your quiz entitlements:

Question Credits

  • Daily Credits — Automatically replenished each day up to your tier's daily maximum (20 for free users, 50 for premium subscribers). Unused daily credits do not roll over beyond the daily cap.
  • Bonus Credits — Accumulated from question pack purchases (funded via Sparks) or promotional rewards. Bonus credits have no expiration or cap and are spent only after daily credits are exhausted.

Sparks (Virtual Currency)

  • Sparks are the App's virtual currency, purchased via consumable in-app purchases (Sparks Packs) or received as a one-time bonus upon activating a Premium subscription.
  • Sparks have no monetary value outside the App and cannot be redeemed for cash or transferred to another user.
  • Sparks are spent within the App to purchase question packs, which convert directly to bonus question credits.
  • Sparks have no expiration date, but are subject to the data loss warning in Section 4.4.

4.3 Subscription Auto-Renewal

The Premium Monthly Subscription automatically renews each month unless you cancel at least 24 hours before the end of the current billing period. Your iTunes/Apple ID account will be charged upon confirmation of purchase and at the start of each renewal period. You can manage or cancel your subscription at any time through your Apple Account settings.

4.4 Important Notice: Reinstallation and Purchase History

⚠️ Critical: Sparks Packs and Bonus Question Pack credits are consumable purchases and cannot be restored after uninstalling the App.

The App stores your question credit balance, Sparks balance, and related flags locally on your device. No user data is collected or stored on our servers. If you uninstall and reinstall the App:

  • Premium Subscription — Your subscription status will be restored automatically when the App verifies your Apple ID entitlements. You can also manually trigger restoration using the "Restore Purchases" option in the Store.
  • Sparks balance — Your Sparks are stored on your device only. Uninstalling the App permanently and irreversibly erases your Sparks balance. Lost Sparks cannot be refunded, restored, or recovered. Apple's standard policy for consumable in-app purchases does not provide for restoration.
  • Bonus Question Pack credits — Question pack credits purchased with Sparks are also stored locally. Uninstalling the App permanently erases these credits. Consumed credits cannot be refunded or restored.
  • Daily Credits — Your daily credit balance will reset to the default starting amount on reinstall.
  • Quiz History — All locally stored quiz history will be permanently deleted.

We strongly advise against uninstalling the App if you have a significant Sparks or bonus credit balance you wish to retain.

4.5 Pricing

Prices for all in-app purchases, including Sparks Packs, Question Packs, and the Premium Monthly Subscription, are set by Sleeping Owl Studios and are subject to change at any time at our sole discretion. Price changes take effect upon the next purchase or subscription renewal period. Continued use of the App after a price change constitutes your acceptance of the new pricing. All prices are displayed in the App Store at the time of purchase and are subject to Apple's applicable taxes and fees.

4.6 Refunds

All purchases are subject to Apple's refund policy. We do not directly process refunds. To request a refund, visit Apple's report a problem page at reportaproblem.apple.com.

4.7 No Guarantees on Question Quality

Credits are spent when quiz questions are requested from our servers. A credit is consumed upon a successful request, regardless of whether you find the generated question satisfactory. AI-generated content is not guaranteed to be accurate, complete, or error-free.

5. AI-Generated Content, Risks & Liability

5.1 Nature of AI-Generated Content

Quiz questions in FlashQuizAI are generated by large language models (LLMs). AI-generated content may:

  • Contain factual inaccuracies, outdated information, or errors
  • Reflect biases present in the underlying model's training data
  • Produce unexpected or nonsensical results for unusual or highly specialized topics
  • Vary in quality from session to session

FlashQuizAI is intended for entertainment, self-study, and educational enrichment only. Do not rely on the App's content as a primary or authoritative source for professional, medical, legal, financial, safety-critical, or any other high-stakes decisions.

⚠️ Disclaimer: All quiz questions and answers generated by the App are AI-produced and must not be treated as factual, verified, or authoritative information. AI-generated content may be incorrect, misleading, incomplete, or outdated. You should independently verify any information before acting on it. Similarly, nothing in the App's generated content constitutes a recommendation, endorsement, or professional advice of any kind — medical, legal, financial, or otherwise. Any reliance you place on quiz questions or answers is entirely at your own risk. Sleeping Owl Studios accepts no liability for decisions made or actions taken based on AI-generated content.

5.2 ⚠️ Critical Warning: Personal Information and AI Input

WARNING: Never enter personal, sensitive, or confidential information into the topic field or custom prompt.

When you submit a topic or custom prompt, that text leaves your device and is transmitted to Sleeping Owl Studios' backend servers, where it is then forwarded to third-party large language model (LLM) providers for processing. You should treat these fields exactly like a public internet search — assume anything you type could be seen, logged, or stored by external systems you do not control.

Specific risks you must understand before using these fields:

  • Third-party AI processing: Your input is processed by external AI systems that Sleeping Owl Studios does not own or directly control. Those providers operate under their own privacy policies and terms of service.
  • Potential AI training use: Depending on the underlying AI provider's policies (which may change without notice), your submitted text could potentially be used to improve or retrain AI models.
  • No application-layer end-to-end encryption: While all communication uses standard HTTPS/TLS transport encryption, your topics and prompts are not additionally encrypted at the application layer before being processed by AI systems.
  • Loss of control once transmitted: Once data leaves your device, Sleeping Owl Studios cannot guarantee, audit, audit logs of, or control how it is handled by downstream AI systems, model providers, or their infrastructure.
  • Unpredictable AI behavior: AI models may inadvertently incorporate or reflect submitted personal information in ways that are unpredictable and entirely outside our control.

Do not include any of the following in quiz topics or custom prompts:

  • Your name, home address, phone number, or email address
  • Passwords, PINs, or security credentials of any kind
  • Financial account details, credit card numbers, or banking information
  • Private medical, psychological, or health information
  • Confidential business, legal, or proprietary information
  • Any information about identifiable third parties without their explicit consent

Sleeping Owl Studios expressly disclaims all liability for any disclosure, exposure, misuse, unauthorized access, breach, or mishandling of personal or sensitive information that you choose to include in quiz topics or custom prompts. By submitting content to the App, you assume full and sole responsibility for that content and its consequences.

5.3 Custom Prompts

The App allows you to provide a custom prompt to guide question generation. By submitting a custom prompt, you agree that:

  • The content of your prompt is lawful and does not violate these Terms or applicable law
  • You will not include personally identifiable information (PII), sensitive personal data, confidential business information, or private third-party information in your prompts (see Section 5.2)
  • You will not use custom prompts to attempt to manipulate, "jailbreak," or extract unintended behavior from the underlying AI model

5.4 No Warranty on AI Outputs

Sleeping Owl Studios makes no representations or warranties, express or implied, regarding the accuracy, reliability, completeness, or suitability of any AI-generated content. The use of AI-generated quiz questions is entirely at your own risk.

6. Acceptable Use

You agree not to use the App to:

  • Submit prompts or topics designed to generate harmful, hateful, illegal, defamatory, or sexually explicit content
  • Attempt to reverse-engineer, probe, or exploit the backend AI infrastructure
  • Circumvent credit limits, subscription verification, or any other App functionality through unauthorized means
  • Violate any applicable local, national, or international law or regulation
  • Infringe upon the intellectual property, privacy, or other rights of any third party

We reserve the right to update our backend systems in ways that may affect response quality or behavior at any time without notice.

7. Intellectual Property

All App content, branding, design, code, and original creative elements are the property of Sleeping Owl Studios and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the App without express written permission.

AI-generated quiz questions are produced dynamically and are not independently owned by us. We make no claim of copyright over AI-generated output, and you should not rely on such output as verified or original creative work.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SLEEPING OWL STUDIOS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT, AND EXPRESSLY DISCLAIMS ALL LIABILITY ARISING FROM YOUR RELIANCE ON SUCH CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SLEEPING OWL STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, CREDITS, SPARKS, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF QUESTION CREDITS, LOSS OF SPARKS CURRENCY, OR LOSS OF ANY VIRTUAL ITEMS DUE TO REINSTALLATION, ACCOUNT CHANGES, OR DEVICE FAILURE
  • ANY HARM ARISING FROM AI-GENERATED CONTENT, INCLUDING FACTUAL INACCURACIES, OFFENSIVE OUTPUT, OR DECISIONS MADE IN RELIANCE ON SUCH CONTENT
  • ANY DISCLOSURE, EXPOSURE, OR MISUSE OF PERSONAL OR SENSITIVE INFORMATION YOU VOLUNTARILY SUBMITTED IN QUIZ TOPICS OR CUSTOM PROMPTS
  • ANY ACTIONS TAKEN BY THIRD-PARTY AI PROVIDERS WITH RESPECT TO DATA SUBMITTED THROUGH THE APP

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sleeping Owl Studios and its affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) any content you submit through the App, including quiz topics and custom prompts; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

11. Game Center

FlashQuizAI optionally connects to Apple Game Center to display and report achievement progress. By using the App with Game Center enabled, you agree that achievement completion data will be transmitted to Apple's Game Center servers in accordance with Apple's Terms of Service and Privacy Policy.

  • Game Center authentication and achievement reporting are handled entirely by Apple's GameKit framework.
  • We do not access your Game Center alias, friends list, or any other personal Game Center data.
  • You may use the App fully without a Game Center account; achievements will be tracked locally only.
  • You can manage your Game Center account and associated data through your Apple Account settings.

12. Push Notifications

FlashQuizAI may request permission to deliver local notifications reminding you when your daily question credits have refilled.

  • Notification permission is entirely optional. You will be prompted once on first launch. Declining has no effect on App functionality.
  • You can enable or disable notifications at any time from the Notifications section in the App's Settings screen, or from iOS Settings > Notifications > FlashQuizAI.
  • Notifications are scheduled locally on your device and do not involve any transmission of personal data to us or any third party.

13. Service Availability

We make no representation that the App or its backend services will be available at all times. The App requires an internet connection to generate quiz questions. We reserve the right to modify, suspend, or discontinue any part of the App or its backend services at any time without notice or liability.

14. Termination

We reserve the right to restrict or terminate your access to the App at any time, without notice, if we believe you have violated these Terms or applicable law. Upon termination, all rights granted to you under these Terms cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7, 8, 9, 10, and 16.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you disagree with the updated Terms, your sole remedy is to stop using the App.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at the address in Section 17. If informal resolution fails, disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Washington for any dispute arising from these Terms.
